Legal chaos for migrants rescued from the “Ocean-Viking”
The Court of Appeal of Aix-en-Provence rejected the retention in the international waiting area of large part of the asylum seekers who arrived in Toulon. The political decision announced on Friday (November 11) was that the 177 adult survivors would be kept “for a maximum of twenty days” in a designated area, as a way to avoid official entry into French territory while studying their “eligibility to apply for asylum.” The difficulty of managing such a number of files according to the legal framework was not taken into consideration, leading to a legal chaos potentially undermining migrants’ rights. read more
