From the boat to prison - The legal and discursive warfare against border crossing in the EU // Vom Boot ins Gefängnis - Der rechtliche und diskursive Kampf gegen Migration in der EU

While European activists such as sea rescuers receive a lot of attention when they become the target of criminalization, the everyday practice of incarcerating non-Europeans facing the very same accusations goes almost unnoticed. However, they constitute the majority of those imprisoned on grounds of “aiding irregular entry”. In a systematic approach, one or two persons per boat are arrested and in this way, hundreds of people sent straight from the boat to prison, sentenced to long prison terms.
This panel aims to shed light on the systematic criminalisation of boat driving under the pretext of "combating smuggling" at the EU’s external borders. We will talk about the realities in Italy & Greece, the respective legal context and potential counter-strategies. Bringing together people with different expertise and experiences, we will address the issue in the context of a general criminalisation of people on the move and those supporting them.
While doing so, we want to take a closer look at the political narrative and public discourse around so-called "smuggling". What is meant when we talk about "smuggling"? Who or what is being criminalised? Why is aiding border crossings considered morally (and legally) right in some cases and wrong in others?
The event will be held in English with translation to German.

- ERIK MBIAKEU / W'ELLCOME UNITED, was imprisoned for "boat driving" in Italy
- SASCHA GIRKE / IUVENTA CREW, is charged in Italy with "aiding and abetting irregular entry"
- MARIA GIULIA FAVA / ARCI PORCO ROSSO PALERMO. The activists of the drop-in-space for migrants in Sicily have encountered and assisted many people who have been criminalised for boat driving. In October, they published an in-depth report on the issue.
- DIMITRIS CHOULIS / HUMAN RIGHTS LEGAL PROJECT SAMOS. The HRLP has been defending people accused of boat driving in Greece for more than ten years. They also represent the father who is being prosecuted for the death of his child as well as the person who drove the boat.

Während europäische Aktivist*innen wie Seenotretter*innen viel Aufmerksamkeit erhalten, wenn sie zur Zielscheibe von Kriminalisierung werden, bleibt die alltägliche Praxis der Inhaftierung von Nichteuropäer*innen, die mit denselben Anschuldigungen konfrontiert sind, fast unbemerkt. Seit Jahren werden unter dem Vorwand der "Schmugglerbekämpfung" Menschen systematisch dafür verhaftet, das Boot, also das Fluchtgefährt, gesteuert zu haben und wegen "Beihilfe zur irregulären Einreise" zu langen Haftstrafen verurteilt.
Diese Podiumsdiskussion beschäftigt sich mit den Realitäten in Italien und Griechenland, dem jeweiligen rechtlichen Kontext und möglichen Gegenstrategien. Indem wir Akteur*innen mit unterschiedlicher Expertise und Erfahrungen zusammenbringen, wollen wir das Thema im Kontext einer generellen Kriminalisierung von Menschen auf der Flucht und derjenigen, die sie unterstützen, diskutieren.
Dabei wollen wir dem politischen Narrativ und öffentlichen Diskurs rund um das Thema "Schmuggel" näher auf den Zahn fühlen: Was ist gemeint, wenn wir von "Schmuggel" sprechen? Wer oder was wird kriminalisiert? Warum ist Hilfe beim Grenzübertritt in manchen Fällen als moralisch (und rechtlich) richtig und in anderen nicht?
Die Veranstaltung findet auf Englisch mit einer Übersetzung ins Deutsche statt.

- MARIA GIULIA FAVA / ARCI PORCO ROSSO PALERMO. Die Aktivist*innen des Drop-in-Spaces in Sizilien haben mit zahlreichen Menschen zutun, die wegen Bootsfahren kriminalisiert wurden. Im Oktober veröffentlichten sie einen ausführlichen Bericht dazu.
- DIMITRIS CHOULIS / HUMAN RIGHTS LEGAL PROJECT SAMOS. Das HRLP verteidigt seit mehr als 10 Jahren Personen, die in Griechenland des Bootsfahrens beschuldigt werden. Sie vertreten auch den Vater, der angeklagt ist, weil sein Kind auf der Flucht ums Leben kam, sowie die Person, die das Boot steuerte.
